Germany’s Ministry for Economic Affairs has drafted a highly conditional, temporary fuel price cap law to replace expiring tax relief measures, setting the stage for a critical battle over energy policy.
The draft legislation, titled the Kraftstoff-Höchstpreisgesetz (KHPG), was leaked to German media on Monday. It comes as Chancellor Friedrich Merz’s coalition scrambles to shield drivers from soaring costs driven by geopolitical conflicts in the Middle East.
A Response to Exploding Pump Prices
Fuel prices in Germany have surged well past €2 per litre following military unrest surrounding Iran, which has choked the critical Strait of Hormuz transport route. To mitigate the crisis, Berlin implemented a temporary 17-cent energy tax cut on October 1. However, that relief is set to expire on December 31, 2026.

The new draft bill is designed to step in on January 1, 2027. It establishes an emergency regulatory safety net modeled after systems used in Luxembourg and Belgium.
Rigid Triggers to Prevent Shortages
Economy Minister Katherina Reiche, who previously criticized aggressive market interventions, has ensured the bill contains strict objective hurdles. Under the draft guidelines, the price cap will not be a permanent fixture. It will only trigger if domestic pump prices outpace the broader European Union trend by more than 5 percentage points for three consecutive weeks.
Furthermore, any activated cap is legally bound to a maximum duration of three months. The draft explicitly mandates that the price restrictions must be suspended immediately if the cap renders fuel imports economically unviable or threatens the national security of supply.
Regional flexibility is also baked into the text, allowing the governments of the individual Länder (federal states) to adjust specific maximum regional thresholds to offset disparate localized logistics and transport costs.
Coalition Ructions Ahead
Despite the breakthrough in drafting the bill, the proposal faces a rocky road through interministerial coordination. Minister Reiche continues to favor alternative measures, such as direct cash payments for low-income earners administered through the Federal Tax Office. Reiche has publicly stated that the current payment system infrastructure remains incomplete, passing the buck to the SPD-led Finance Ministry to modernize the framework before alternatives can be deployed.
The Federal Cartel Office (Bundeskartellamt) is expected to play a heavy enforcement role in monitoring the data flow via its Market Transparency Unit if the law passes. Station operators who breach the regional price maximums will face severe administrative fines. Parliamentary debates on the KHPG draft are expected to intensify in the coming weeks as the December tax discount expiration looms.
